This Privacy Policy (“Privacy Policy”) describes how Aisha AI LLC (“Aisha”, “we”, “us” or “our”), handles personal information, including information processed through our AI-driven assistant (“Aisha AI”) developed by Onyx Impact. This Privacy Policy applies to all interactions with Aisha AI through its website aisha.ai, mobile application and other platforms, including the Digital Green Book website (digitalgreenbook.org), the Onyx Impact website (onyximpact.org), and any related services or products that post a link to this Privacy Policy (collectively, referred to herein as the “Services”).

What personal information do we collect?

We collect identifiers (name, email, phone number), demographic information (age, gender, state), user content you provide to Aisha AI, device information, IP address, and usage data. See Section 1 for more information.

How do we handle your AI conversations?

Your inputs are used solely to generate outputs within your chat session. We do not use your conversations for other business purposes or to train or fine-tune Aisha AI. Only you can access your chat history. When you delete your account, your conversations are permanently deleted. See Section 4 for more information.

What are your rights and choices?

You can:

  • Request access to, correction, or deletion of your personal information (including your account and associated data) by emailing us at privacy@aisha.ai.
  • Click the “unsubscribe” link in marketing emails to stop receiving them.
  • Manage or disable cookies directly in your browser settings.

Can children use Aisha AI?

No. Our Services are designed for users ages 18 and older. We do not knowingly collect personal information from individuals under 18. See Section 11 for more information.

1. What Personal Information We Collect

We may collect the following categories of personal information about you directly from you and automatically through your use of the Services.

Information You Provide to Us

  • Identifiers and Contact Information: Name, email address, and phone number.
  • Demographic Information: Age, gender, and state.
  • User Content, Audio and Visual Information: Information you input into our Services – including your prompts, queries, or other content you provide or upload to Aisha AI, such as files, images, text, video and audio (including audio captured through your device's microphone, if you grant permission) ("Prompts" or "Inputs") – which generate responses or content ("Outputs") based on your Inputs. If you include personal information or reference external content in your Inputs, we will collect that information and this information may be reproduced in your Outputs. We use your Inputs solely to generate Outputs within your chat session. We do not use your Inputs or conversations for any other business purpose or to train or fine-tune Aisha AI.
  • Customer Support Information: Information or inquiries you submit to us via email or other customer support channels.
  • Feedback on Your Use of the Services: Ideas or suggestions for improving or rating an Output in a response to an Input ("Feedback"). If you rate an Output in response to an Input (for example, by using the thumbs up or thumbs down icon), we will store the entire related conversation as part of your Feedback.

By accessing or using any of our Services' communication features, you agree that we may record and retain transcripts of all communications with you. Conversations that you have with Aisha AI are encrypted and hashed so that only you can access your chat history (neither Aisha AI or any third party has the "key" to unlock that encryption). When you delete your Aisha AI account, your conversations are permanently deleted.

Information Automatically Collected

  • Device Information: Device type, operating system information, time zone setting, IP address (including information about the location of the device derived from your IP address), identifiers (including device or advertising identifiers and other unique personal or online identifiers).
  • Internet and Network Activity: Browser type, IP address, pages visited, referring URLs, time on site, as well as information about how you interact with Aisha AI, including usage patterns, and chat logs.
  • Usage Information: Information about how you use our Services, such as the dates and times of access, browsing history, search, and other information about how you use the Services.
  • Cookies and Related Technologies: We and our service providers may use Cookies (as defined below) to manage the Services and to collect information about you and your use of the Services. These technologies help us to recognize you, customize or personalize your experience, analyze the use of our Services and to make them more useful to you. De-Identified Data

We may process personal information in an aggregated or de-identified form to analyze the effectiveness of our Services, conduct research, or study user behavior.

Aggregated or de-identified data cannot reasonably be linked to an identified or identifiable individual. We maintain and use de-identified data without attempting to re-identify it, except as permitted by law to determine whether the de-identification process is functioning properly.

2. Sources of Information

This information is collected through various means, including:

  • Directly From You: We collect information directly from you, when you communicate or interact with Aisha or Aisha AI via our chatbot & voice conversations or other Services, or reach out for support or to receive emails from us.
  • Automatically through Cookies and Related Technologies: When you visit the Services, we automatically collect information through cookies, web beacons, and similar tracking technologies. This information helps us understand how visitors use our website and improve our Services. For more information, please see the Cookies and Related Technologies section below.

3. How We Use Your Information

Aisha uses the personal information collected for the following purposes:

  1. To Provide the Services and Fulfill Your Requests: We use your information to provide and maintain the Services, such as answering your questions about news and digital safety, connecting you with Black-owned businesses and organizations, and guiding you to resources for financial or community support; to process and fulfill your requests; to process your donations; to communicate with you about your use of our Services; to respond to your inquiries; and for other customer service and business administration purposes.
  2. To Improve the Services: We use your information to understand and analyze our user base and how you use our Services, to improve and enhance the Services, and to develop new content, services, features, and functionality.
  3. To Communicate With You: To send important updates, support, and promotional information, including information relevant to the Services provided.
  4. For Marketing and Promotional Purposes: We may use your information to send you marketing, newsletters, event updates, and to communicate with you about new products or events. We may also use your personal information to improve our marketing and promotional efforts. Where required by applicable law, we will obtain your prior consent before using your personal information for marketing and promotional purposes.
  5. To Comply with Legal Obligations and Resolve Disputes: We may use your information where we believe necessary to comply with our legal, governmental, or institutional obligations or to exercise or defend our rights or the rights of a third party, including complying with law enforcement or government authority requests and participating in compliance audits. We may also use your information to investigate and resolve disputes, and investigate and resolve security issues.

To Protect You, Us, and Others: We may use your information where we believe necessary to investigate, prevent, or take action regarding suspected or actual illegal activities, detect or prevent fraud or abuse, or situations involving potential threats to the safety of any person or to otherwise protect us, you, and other users. We may use your information to enforce this Privacy Policy, our Terms of Service, protect the integrity of the Services, or to comply with the law.

4. Artificial Intelligence Features

In addition to the data practices described above, this section describes how we process your personal information when you use our artificial intelligence features.

Aisha implements and makes available features that include, utilize, operate with, or are based on artificial intelligence (each, an “AI Feature”). When you use an AI Feature, certain types of your personal information may be processed by and/or transmitted to third-party providers to enable the functionality. For example, an AI Feature may capture your voice or text inputs, as well as the outputs generated in response to your query. We and our third-party AI providers use your Inputs solely to generate Outputs within your chat session. Neither we nor our providers use your conversations for any other business purpose, nor do we use them to train or fine-tune Aisha AI.

5. Disclosure of Personal Information

We share your personal information in the following cases:

  • Affiliates: We may disclose information to our affiliates in connection with any of the uses of your personal information set out in this Privacy Policy. Also, where we are permitted to do so under applicable law, we may disclose personal information to other companies in our family of companies so that they can contact you about other services we provide.
  • Service Providers: We disclose information, including all categories of personal information, with entities that process information on our behalf. Service providers assist us with services such as data analytics, website hosting, and technical support. We contractually prohibit our service providers from retaining, using, or disclosing information about you for any purpose other than performing the services for us or if otherwise permitted by applicable law. We may permit them to use information that does not identify you (including information that has been aggregated or de-identified) for any purpose except as prohibited by applicable law.
  • Third-Party AI Providers: Your encrypted and hashed prompts (the Input you provide to Aisha AI, such as text queries) are shared with third-party AI providers so they can process the data to generate Outputs.
  • Partner Organizations: We may share personal information with partner organizations, particularly those whose missions align with ours. For example, we may share your personal information with partner organizations when you have directed us to do so or have otherwise provided consent where requested.
  • Legal Compliance: If required by law or in response to valid legal requests, such as subpoenas or other government demands, we may disclose your data to authorities.
  • Business Transfers: In the event of a merger, acquisition, reorganization, or similar transaction involving our organization, your personal information may be transferred to the successor organization.
  • With Your Consent: We may otherwise disclose your personal information when you give us permission or direct us to disclose your information, including as part of the Services.

7. Your Choices

  1. Account Deletion: You can delete your account along with all associated data, including chats and interactions, directly from the profile section of Aisha AI and click "Delete Account". This will remove all personal information and data stored in the app.
  2. Email: You can unsubscribe from Aisha's marketing or promotional emails at any time by using the "unsubscribe" option in the emails we send.
  3. Cookies: You have the option to manage or disable cookies through your browser settings. Please note that disabling cookies may limit certain functionalities of Aisha and as further described in the Cookies and Related Technologies section above.

8. Your Rights

We provide the following rights to all of our users, regarding your personal information:

  1. Right to Access: You may request confirmation of whether we process your personal information and access to such information.
  2. Right to Correct: You may request that we correct inaccuracies in your personal information.
  3. Right to Delete: You may request that we delete personal information we have collected from or about you.

How to Exercise Your Rights: To exercise your privacy rights, please email us at privacy@aisha.ai

We do not use or disclose personal information for profiling in furtherance of decisions that produce legal or similarly significant effects.

Verification: We may need to verify your identity before fulfilling your request. We will use reasonable methods to verify that the person making the request is the person about whom we have collected data.

Authorized Agents: You may designate an authorized agent to submit a request on your behalf. We may require the authorized agent to demonstrate authority to act on your behalf.

Appeal Process: If we decline to take action on your request, we will inform you of our reasons. You have the right to appeal our decision. To submit an appeal, please follow the instructions in our response to your request. If your appeal is denied, we will provide you with information on how to contact your state Attorney General or other applicable enforcement authority to submit a complaint.

Nondiscrimination: We will not discriminate against you for exercising any of your privacy rights under applicable law, including by denying goods or services, charging different prices or rates, or providing a different level of quality of goods or services.

9. Data Security

Aisha takes reasonable steps to protect your personal information from unauthorized access, alteration, or disclosure. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we implement and maintain reasonable physical, technical, and administrative procedures to safeguard and secure information collected. Nevertheless, transmission via the Internet is not completely secure and we cannot guarantee the security of information about you. While no security system is perfect, we strive to maintain robust protections to safeguard your privacy.

10. Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy or as required by law. To determine the appropriate retention period, we consider various criteria, including whether the personal information continues to be necessary to provide our Services; the amount, nature, and sensitivity of the personal information; the potential risk of harm to consumers from unauthorized use or disclosure; and the purposes for which we collect the personal information. Except as otherwise permitted or required by law, if personal information is no longer needed, we will securely delete or anonymize it in accordance with our data retention policies.

Aisha AI is designed to interact with users aged 18 and older. We do not knowingly collect personal information from individuals under 18. If you are under the age of 18, please refrain from providing any personal information through our platform. If you believe that we may have inadvertently collected data from a minor, please contact us at privacy@aisha.ai for deletion.

12. Updates

This Privacy Policy may be updated periodically. We will notify users of significant changes by updating the "Last updated" date above. If we make changes, we will notify you by revising the "Last Updated" date at the top of this Privacy Policy. If we make material changes, we will provide you with additional notice (such as adding a statement to our homepage or sending you an email notification), and in some cases you may have the right to withdraw your consent to further processing.
